General Terms and Conditions of Sale
1. General provisions
These general terms and conditions define, without prejudice to the application of specific terms and conditions, the respective obligations of the contracting parties in connection with sales and services carried out by our company within the framework of e-commerce in Europe. By accepting the order confirmation via our website, our contracting party expressly acknowledges having read, understood and accepted these general terms and conditions, it being understood that any order for a product via our website implies consultation and express acceptance of the general terms and conditions of sale.
These general terms and conditions of sale may be saved or printed by the customer. Provisions that have not been expressly waived remain applicable. Only exceptions subject to our written agreement may modify the application of these general terms and conditions. In the event of any conflict between the general terms and conditions of our contracting parties and our own, it is agreed that the latter shall prevail.

2. Products
Unless otherwise expressly agreed in writing, the products we offer on our website are those displayed there on the date of the order, subject to availability.
The texts, graphics, information and specifications illustrating the products are non-contractual, are provided for information purposes only and may be modified. Photographs are non-contractual, and printing or the quality of the website may affect the rendering of colours or materials compared with reality.
3. Orders
Any order entrusted to us shall only become binding upon written confirmation from us by email.
The order is placed by clearly, completely and accurately filling in the mandatory fields of the online order form, following the steps described.
Any applicable delivery costs are calculated during the purchasing process and added to the order price.
Any modifications made by the customer to their order form or to our offer shall only be valid if we have accepted and confirmed them in writing.
In the event of unilateral cancellation of an order by the contracting party, we reserve the right to claim compensation equal to 30% of the total order amount.
The consumer as defined in Article I.1 of Book 1 of the Belgian Code of Economic Law may claim the benefit of the application of compensation and interest to the extent and under the conditions set out in this clause in the event of failure to fulfil our obligations.
4. Order confirmation
The sales process operates as follows:
- The customer adds the product(s) to their basket.
- The customer can then view their basket. When viewing their basket, the customer can see a summary of their order and the price.
- When the customer clicks on “checkout”, they are taken to a page containing:
A form to be completed with the buyer's details (surname, first name, full address, email, telephone number, delivery address). Please note that this form will already be completed if the customer has previously registered and logged into the website.

The choice of collection point, if this option has been selected.
- Once payment has been made, the customer automatically receives an email containing the details of their order.
- As soon as the funds have been received in our bank account, we dispatch the order.
5. Delivery times
The usual delivery times for our shipments are 24 to 48 hours (sometimes 72 hours) from the date on which payment is received in our bank account.
Even in such cases, the following circumstances release us from our delivery time commitments:
1 – Cases of force majeure (including, in particular, strikes, technical incidents, flooding, fire, shortages of the product from our supplier, computer viruses, epidemics, etc.);
2 – If the payment conditions are not complied with;
3 – If the customer fails to provide us with the information necessary to process their order.
6. Deliveries – transport
The ordered product(s) will be delivered to the address provided by the customer when placing the order. We cannot be held responsible for delivery to an incorrect address if that is the address provided by the customer.
7. Right of withdrawal – information – buyers acting for non-professional purposes
You may return one or more items within 14 days of the date on which you received your purchase. Items must be returned to us in their original packaging and in perfect condition. The procedure for returning an item is set out on the Returns page of our website. Once your parcel has been received and your return has been approved by our returns centre, you will be refunded. The refund period is between 5 and 10 working days following receipt of the parcel at our inspection centre. Return shipping costs shall be borne by the customer.
8. Prices
The price charged for each product is the price in force on the date of confirmation of the reservation, as displayed on the website www.osierjosephine.be. Prices are stated in euros and include VAT.
Unless otherwise stated, the displayed prices do not include order processing fees (where applicable) or transport costs, which will be invoiced separately.
Our prices are, in principle, not subject to revision; however, we may pass on any changes to the VAT rate occurring before the delivery date.
9. Payment
The payment methods currently available are “Bancontact” / “Credit card” / “Bank transfer”. Orders will only be dispatched after payment has been verified. The delivery times mentioned in Article 5 only begin from the date on which payment for the order is received in our account.
10. Warranty in the event of sale – Buyer acting for non-professional purposes
The buyer benefits from the statutory rights under the Law of 1 September 2004 on consumer protection in the event of the sale of consumer goods.
In accordance with Article 1649quater §2 of the Civil Code, the consumer is required to inform the seller of the existence of a lack of conformity within two months from the day on which the consumer discovered the defect. After this period, any right to repair or replacement shall expire.
Notwithstanding the above, you shall not be entitled to any warranty:
- In the event of normal wear and tear of the product;
- In the event of irrational or abnormal use of the product, or if it is used contrary to its intended purpose;
- In the event of failure to comply with the instructions for use and/or maintenance;
- In the event of damage to the product, whether intentional or caused by negligence;
- If the product has been modified by you or through the intervention of a third party not designated by Osier Joséphine;
- In the event of commercial use.
11. Privacy protection – processing of personal data
Personal data provided by the customer is strictly confidential. We undertake to use it only for the purpose of processing and properly fulfilling the customer's order and to allow access to this information only to members of staff who need to know it for the proper management of orders.
This data may be used for marketing purposes by our services. If the customer does not wish their data to be used for these purposes, they are requested to contact us by email or post.
All data received may be modified at any time upon simple request by telephone or email.

12. After-sales service
A contact form is available on the website under the “Contact” page and allows customers to contact the customer service department with any questions relating to a product, an order, a refund, a return or any other matter.
13. Disputes
In the event of a dispute between the parties or legal proceedings for payment, only the courts having jurisdiction over our registered office, in the French language, shall have jurisdiction.
The applicable law is Belgian law.
14. Amendments to the agreement
Any amendment to the specific agreements or these general terms and conditions must be made by means of a written amendment signed by all parties.
15. Severability clause
The invalidity or illegality of any of the clauses contained in the contracts (specific and general terms and conditions) agreed between the parties shall in no way result in the invalidity or nullity of the other terms of the contract concluded between the parties, which shall remain fully valid.
